Representations & Guarantees A purchase shall not be considered an “approval” sale. If any substantial defect not described in the listing is found by the Purchaser, the item(s) must be returned within two days of receipt. Item(s) may not be returned except for reasons of authenticity or substantial defect in description see (“Condition” below for details). We warrant to the original purchaser for a period of ten (10) years from the date of the sale the authenticity of any item purchased. This warranty is limited to a refund of the purchase price upon the return of the merchandise to our parent company Old Town Historical Documents, llc, in satisfactory condition. Old Town Historical Documents, llc, is not liable for any other damages, including consequential damages. There are no other warranties of any nature either expressed or implied, including but not limited to the warranties of merchantability and fitness for a particular purpose. Authenticity Each hand-signed document has been authenticated and is accompanied by a certificate of authenticity issued by our parent company Old Town Historical Documents llc. The term of the COA is 10 years from the date of purchase and is valid to the original purchaser only. We have great thoroughness in our research, our business integrity and service to our clients. Condition We have tried to accurately describe every item at Art & History Gallery. If any substantial defect not described at Art & History Gallery is discovered by the purchaser, the item(s) must be returned within two days of receipt. This is not an approval sale. Please call us for an authorization before returning the item(s). A merchandise credit will be issued in the case of an unresolved dispute over condition. Make an Offer Option Following an offer submission, customers will be contacted via their Art & History Gallery account email address. Our response will be either to accept your offer, decline your offer or send you a counteroffer. Any price discount that results of the “Make Offer” process cannot be combined with any other discounts or promotions (e.g. free shipping) and will be the final offer price for the item. During the Make an Offer process items will remain available to all users until a purchase has been made and payment received. Therefore, we suggest that users check theirs emails frequently for our response as purchase of an item is subject to its availability. Under certain circumstances offers may be cancelled prior to the offer expiration date and users may not always be notified of an offer status change.
Seller’s Rights Old Town Historical Documents llc reserves the right to withdraw any item from its Art & History Gallery website, reject or exclude any party from purchasing at Art & History Gallery for any reason it deems appropriate. Sole discretion in these matters’ rests with Old Town Historical Documents llc. Decisions of Old Town Historical Documents are final. Prices are subject to change without notice. This sale is being held in accordance with the laws of the State of Florida, and any and all proceedings to enforce the terms and conditions of this sale will be brought in Charlotte County, Florida.
All sales are final, but may be rejected by Old Town Historical Documents llc for any reason it deems appropriate, at its sole discretion.
Payment Methods We accept and prefer as payment Visa, MasterCard, PayPal, and US currency. We typically do not accept personal checks however if an exception is made, the merchandise will not be released until the funds have cleared through your bank account. Wire transfers are permitted for purchases exceeding $10,000.00 and allow us to release the merchandise immediately upon receipt. Please call for bank wire transfer instructions when wishing to make a payment by this method. All amounts are in US currency.
Payment Terms Payment is due at the time of purchase. The purchaser is responsible for all shipping costs as well and international customs duties and all applicable State and Local taxes. Title of item(s) passes to the purchaser when payment in full has been received by Old Town Historical Documents llc. There will be an additional charge of 25% of the check amount for a check that is returned to us by your bank. For any item(s) which has a substantial defect or authenticity dispute, the risk of loss shall remain with the purchaser until the item(s) is returned to and received by Old Town Historical Documents llc, which must take place within two (2) days of receipt of the item(s) by the purchaser.
Shipping No merchandise shall be shipped or delivered until payment in full is received. All items will be shipped via UPS FedEx or USPS, unless otherwise noted. In general, for the purchase of multiple, unframed, flat items in a given sale, a one-time flat fee will apply. Some exclusions to this rule may exist. Shipping fees include packaging, insurance, and shipping charges.
Framing Options All item(s) are being sold unframed unless they are represented in a frame and then it is "as is" condition.
